105 – Changes to Alberta’s Safety Codes Due to High Intensity Residential Fires

Alberta Municipal Affairs has implemented several amendments to the Alberta Building and Fire Codes due to large-loss fires known as High Intensity Residential Fires. These changes are a result of the recommendations from the High Intensity Fire Working Group and a series of proposed changes that were developed by the National Research Council. The changes deal with several issues:

  • Fire protection requirements on the exterior of buildings that are located close to property lines.
  • Fire protection of soffits and eaves when buildings are located close to property lines.
  • Size restrictions on windows that face property lines.
  • New criteria for determining appropriate fire department response times.
  • New requirements regarding the protection of adjacent buildings from fire spread during construction.
  • Expanded fire safety plan requirements.
  • Access to construction sites for fire fighting equipment requirements.

This presentation will highlight all of the changes and provide an opportunity for attendees to ask questions.

106 – Prime Contractor and Liability Issues

Despite it's being part of the Occupational Health and Safety regime in Alberta for many years, there haven’t been any cases before the Alberta courts to spell out what a Prime Contractor actually does, the extent of their obligations, and how they are to meet them. Is there a difference for oil and gas, commercial, and residential industries?

This session is designed for owners, employers, managers, and supervisors who enter into an agreement with the owner to be prime contractor. Awareness and potential liability are perhaps the two most common concerns when being prime, as such, numerous and considerable questions remain: What is the extent of the Prime Contractors responsibility anyway? What does the legislation mean by “system and process”?  What does negligence mean and how can I avoid it?

This informative session offers valuable insights into liability and responsibility issues facing many prime contractors, and provides a practical “how to” approach to being prime contractor.

110 – Geothermal Case Study: Alberta Regional Council of Carpenters and Allied Workers Training Centre

The Alberta Regional Council of Carpenters and Allied Workers recently opened the doors of its new training centre. The building incorporates what is to date Alberta's largest geothermal heating and cooling system, involving 110 boreholes, each to a depth of 200 feet.

The four key players of this project (owner, architect, engineer and contractor) will review the geothermal objectives, planning considerations and implementation process. They will discuss challenges, lessons learned and benefits gained.

203 – Security in this Modern Age: Design vs Application and Future Trends

Since 9/11, security has changed dramatically. No longer are doors left unlocked or unwatched while kids go to school or adults go to work. This insightful session will discuss the evolution of security in buildings from both hardware and access perspectives. 208 – The Law of Tendering

This session will cover the rights and obligations of all of those involved in the tendering process. What are the obligations of those parties who submit tenders and what are the obligations of those parties who call for tenders? Can the person calling for tenders accept a non-compliant tender? Does a tender have to have all the i’s dotted and the t’s crossed to be a compliant tender or is a substantially compliant tender sufficient? What is a substantially compliant tender? What damages is the tenderer liable for who refuses to enter into Contract B? Is the tender-calling authority responsible for damages and, if so, how much if the tender-calling authority wrongfully awards a tender? Can a tender-calling authority bid shop after tenders close? Does the privilege clause (the lowest or any tender will necessarily be accepted) give the tender-calling authority any rights? Can that tender-calling authority amend a tenderer’s tender after tenders close if the tender package permits the tender-calling authority that right?

These are all questions of interest, not only to the construction industry, but to any party involved in the tender process. The tender process of course includes requests for proposals and thus can cover a wide range of commercial transactions.

213 – Builders Liens

Who is entitled to file a builders' lien? Is the estate and interest of Governments lienable? What are the proper times within which to file a builders’ lien? What is a prevenient arrangement? Can a change of title defeat a claim for lien? How do the major lien fund and minor lien fund work? If they don’t work under your contracts, how can you redraw your contracts to minimize the possibility of builders’ liens being filed, but still protecting your interests as the owner or contractor? Are arbitration clauses enforceable when builders’ liens are filed? How does one remove a builders’ lien from a certificate or title? Are there limited trust provisions in Alberta and how does one protect one’s self from ensuring that one can properly make progress payments without bearing double jeopardy if builders’ liens come on title to the property?

These are the questions, the answers of which will be provided at this seminar, which are extremely important to all members of the construction industry.

214 – Injury Prevention by Design

Traumatic or degenerative musculoskeletal injury can result from design that does not adequately consider the interaction of people with the built environment. Prevention of injury through responsible design begins with an understanding of when and why injuries are likely to occur. Design decisions then become a critical part of injury risk management. This session will provide an understanding of why injuries occur, how interaction with the built environment can contribute to the risk of injury, and strategies for injury prevention that can be integrated into both design and purchasing processes.
